ANALYSIS The City staff and FCUSD agree that the joint-use library on the campus of Vista del Lago High School should operate seamlessly as one institution with the combined mission to serve both the public at large and the students of the district. Staff and FCUSD have worked to develop an equitable agreement that meets these two distinct missions. Staff has outlined the key issues and resolutions addressed in the joint-use agreement in Attachment 1. The Library Commission reviewed and recommended approval of these issues and resolutions at its May 4, 2004, and June 6, 2005, meetings. Staff believes that the language negotiated in the draft Agreement achieves the objective originally contemplated in June, 2003, when the City Council approved the concept of a joint-use library. Staff recommends that the City Council authorize the City Manager to execute an agreement with FCUSD to maintain and operate the joint-use library on the Vista del Lago High School campus. FCUSD staff expects phase 1 construction work on the Vista del Lago campus to start in the fall of 2005. The joint-use library facility is in phase 2 of the project, which FCUSD staff expects to begin sometime in early 2006. FINANCIAL ANALYSIS The formula for dividing the fiscal responsibility of the joint-use Library is based not only on the percentage of hours utilized by each organization, but also the value each organization receives from the partnership. The City/FCUSD operating split, based on hours utilized, is approximately 71 % City / 29% FCUSD. FCUSD recognizes that the Vista del Lago students benefit from the extended library hours as a result of the City staffing the Library during and after the end of the FCUSD library staff's shift, and FCUSD has agreed to a 60% City / 40% FCUSD operating cost split, exclusive of staffing costs. Staff's current estimate of the total costs to operate the joint-use library, including staffing costs, is $262,000, beginning in fiscal year 2007-2008. To the extent replacement furniture and equipment is necessary, the City and FCUSD will split the cost at 50%, with the exception of technology equipment, in which the City and FCUSD propose to contribute funding for replacement of technology equipment on a five-year cycle, based on the percentage of equipment identified initially installed 35% City / 65% FCUSD. Proposed modifications or improvements to the Library facilities shall be negotiated in good faith by the City and FCUSD. To the extent such modifications and improvements benefit each party's use of the Library, each party shall bear a pro-rata share of the cost thereof. The cost sharing formula shall be determined prior to the commencement of any modification or improvement. ATTACHMENTS 1.
