The City of Folsom Conflict of Interest Code
And Filing of FPPC Statement of Economic Interests (Form 700)


The California Political Reform Act (Government Code Sections 81000, et seq.) requires many local public officials and employees to file public, personal financial disclosure reports known as Statements of Economic Interests – Form 700.

Under the Act, cities are required to adopt and implement a separate Conflict of Interest Code.  Designated Employees, Commissioners, and Elected Officials must file Statements of Economic Interests.  The designated filers and the types of economic interests they must disclose and listed in the City of Folsom’s 
Conflict of Interest Code.

The City Clerk, as Filing Officer, administers the Conflict of Interest Code at the local level and notifies each designated official, employee, commissioner and committee member of his or her filing obligation.  Officials designated in the Conflict of Interest Code are required to file an Assuming Office Statement when they assume a designated position, an Annual Statement each year (by April 1) and a Leaving Office Statement within thirty days of resignation or termination.  Each type of statement has a specified “reporting period.”  Filers must sign the Form 700 under penalty of perjury.  Once filed, the form is a public document and must be made available to the public upon request.

FOLSOM CITY COUNCIL ELECTIONS:

Folsom’s City Charter establishes the Folsom City Council as five members elected at large by the voters of the City. Only resident registered voters of the City shall be eligible to hold the office of City Council Member.     

On November 2, 2010, registered Folsom voters will elect three members to the Folsom City Council.  The terms of City Council Members are staggered; the seats currently held by Jeff Starsky and Ernie Sheldon expire in November 2012.  The remaining three seats on the City Council are currently held by Steve Miklos, Kerri Howell, and Andy Morin. Their terms end in November 2010.

City of Folsom Campaign Sign Regulations  Campaign signs pertaining to an election to any public office or ballot measure may be erected not earlier than sixty days (September 3, 2010) prior to the said election and shall be removed within seven days (November 9, 2010)

FPPC (POLITICAL REFORM ACT) CAMPAIGN DISCLOSURE FILINGS 

All city council members, candidates for city council, and all committees supporting or opposing local candidates or ballot measures are required to file campaign disclosure statements disclosing contributions received and expenditures made.   Individual and committee filing requirements will vary based upon their activity.  All statements filed are a matter of public record.  They may be inspected at City Hall, City Clerk’s Department by anyone, and copies can be purchased at ten cents ($0.10) per page.

GUIDELINES FOR IMPOSING AND WAIVING FINES
The Political Reform Act provides that Campaign Disclosure and Statement of Economic Interest forms which are filed late are subject to fines.  As the filing officer for the City of Folsom, the Folsom City Clerk’s Department enforces these fines.  These Guidelines shall provide clear and consistent implementation of fines and waivers related to campaign disclosure and statements of economic interest.   

CAMPAIGN CONTRIBUTION LIMITS

In 1994,  the voters of Folsom approved Measure V, which enacted Folsom Municipal Code Chapter  2.48 – Campaign Contribution Limits.  Measure V, in part, imposed a $150 campaign contribution limit.     Measure V acknowledged that, inherent to the high cost of election campaigning is the problem of improper influence, real or potential, exercised by campaign contributions over elected officials. It was the purpose and intent of the people of the city in enacting Measure V to preserve an orderly political forum in which individuals may express themselves effectively; to place realistic and enforceable limits on the amounts of money that may be contributed to political campaigns in municipal elections; to limit contributions by organizations in order to develop a broader base of political efficacy within the community; to limit the use of loans and credit in the financing of municipal election campaigns; and to provide full and fair enforcement of all the provisions of the established campaign contribution limits.   

 

REGISTERING TO VOTE  

REMEMBER: If you have moved, changed your name or party affiliation, you must re-register to vote. 

The Constitution of the United States guarantees the right to vote to all citizens who are 18 years of age and not imprisoned or on parole for the conviction of a felony. Registration is the first step in exercising this constitutional right. In California, registration is permanent and a new affidavit of registration need only be executed if you have changed your name, address or wish to change your party affiliation.

In California, the deadline to register to vote for an election is 15 days before each local and statewide Election Day, so please register early.   Persons may continue to register after the cut-off period, but cannot vote in the upcoming election.Voters may register with the Sacramento County Voter Registration Department

The actual registration procedure takes only a few minutes of your time and is accomplished by completing and mailing a postage paid voter registration card. The card is addressed to the Sacramento County Voter Registration and Elections office.
