The Folsom Municipal Code was passed March 22, 2022.

The 2025 California Building Code to be adopted on January 1, 2026

The California Building Standards Commission requires each City and County to update their construction codes every three years. The new 2025 California Building Standards Code (Title 24) goes into effect on January 1, 2026.

Any building permit application submitted prior to January 1, 2026, can be submitted under the 2022 Code cycle and can remain active under that Code cycle so long as the application and/or permit does not expire. If either the application or permit expires, the project must be submitted as a new building permit application under the 2025 Code cycle (updated documents, new application, new fees, etc.). Applications for building permits submitted on or after January 1, 2026 shall conform to the 2025 Building Code. Please note, the City of Folsom only accepts permit applications through eTrakit. December 31st and January 1st are City Holidays.

Starting November 10th, the City of Folsom will start accepting permit application submittals designed under the 2025 Code.

Expiration of Building Permit Applications

Under current Code, Permit Applications expire 180 days after the date of filing unless the permit has been issued. If the Building Permit has not been issued before expiration, a new application must be filed under the current Code at the time of application.

Expiration of Building Permits

Under current State Law, Building Permits expire 12 months after issuance of the Building Permit unless work has commenced to the satisfaction of the Building Official or, if more than 180 calendar days elapses between approved required inspections after the initial 12-month period. Per the Folsom Municipal Code, Building Permits expire two years after permit issuance.

A one-time extension of 180 calendar days may be granted. The extension shall be requested in writing prior to expiration with justifiable cause demonstrated.

AB 130 Legislation Affecting Master Plans and Production Permits

On July 1, 2025, the State Legislature passed Assembly Bill 130 amending Health and Safety Code Section 18938.5:

18938.5.

(d) Notwithstanding subdivisions (a) to (c), inclusive, the state and local building standards in effect at the time an application for a building permit is submitted, for a residential dwelling based on a model home design approved under those standards, shall apply to all future residential dwellings based on that approved model home design in the same jurisdiction, unless the model home design substantially changes at a later date or 10 years have passed since the building permit for the model home design was approved by the jurisdiction, whichever comes first.

AB 130 is intended to lower construction costs to address a housing shortage in the state of California. It allows building permits to be issued based on approved master plans for ten years. The ten-year timeline commences on the first production permit submittal date.

Based on this legislation and the new 2025 code cycle adoption effective January 1, 2026, the City of Folsom will take the following steps to comply with current legislation:

• Master plans will be reviewed under the Applicable Code at the date of submittal. •
• Production permits based on the approved master plan may be pulled for up to ten years from when the first production permit is submitted, so long as no significant changes have been made to the master plan.
• If a master plan is approved, but no production permits have been submitted prior to a subsequent code update, the master plan shall no longer be valid.
• Significant changes to a master plan may include (but are not limited to) new geographic location, change in building square footage, or amendments to the code by the State Fire Marshal.
• Once a master plan is updated for new code requirements, the previously approved master plan shall no longer be valid.
• Master plans expire one year after approval if no production permit has been submitted.

Submitting a Major Permit? Permit applications submitted after October 20, 2025, that require plan review will be submitted via eTRAKiT. Once the application process is completed and plan check fees are paid, the plans will be routed for review. Once the plans and documents are approved by plan review staff, issuance fees will be paid through eTRAKiT. Once the permit is issued, all approved plans and supplemental documents will be provided through a file-sharing link.

The Intake Team will contact the applicant via email with any issuance fees (if any fees are still due) or if any additional documentation is required. Issuance fees can be paid through eTRAKiT. Once issued, the approved documents will be available through eTRAKiT.
