Adults age 21 and older must obtain a permit to consume alcohol in public places.

No, drinking is not allowed near children's play areas. The Folsom Municipal Code prohibits drinking in children's play areas and play fields, including the Steve Miklos Aquatic Center, Cummings Family Park, and the Ernie Sheldon Youth Sports Complex.

The intent is to enhance the enjoyment of city facilities for all residents and visitors. Most other cities have laws prohibiting or limiting alcohol use in parks and other public places.

The Alcoholic Beverage Permit is issued in accordance with Section 9.105.050 of the Folsom Municipal Code allowing the consumption of alcoholic beverages in conjunction with the temporary use and occupancy of public property or public areas. Chapter 9.105 of Title 9 of the Folsom Municipal Code makes it unlawful for any person to consume, or possess an open container of any alcoholic beverage on public property or a public area in the City of Folsom except as provided in Section 9.105.050. Alcoholic beverage means any alcohol, spirits, liquor, wine, beer, and every liquid or solid containing alcohol, spirits, wine, or beer, and which contains one-half of 1 percent or more of alcohol by volume and which is fit for beverage purposes either alone or when diluted, mixed, or combined with other substances, as set forth in California Business and Professions Code Section 23004.

The first two offenses are infractions, punishable by a fine up to $100 for the first offense and $200 for the second. The third offense is a misdemeanor.
